General Terms and Conditions of Use (GTC)

These General Terms and Conditions of Use (hereinafter referred to as "GTC") govern access to and use of the LMS Pro platform (hereinafter "the Platform"), accessible at the following address: https://lmspro.fr.
By creating an account and/or using the Platform, the user acknowledges having read these Terms and Conditions and accepts them without reservation.

1.2 Hosting Provider
The Platform is hosted by Gandhi (hosting provider).
Contact: via Gandi's public support and information channels.
2) Definitions
- User : any person browsing the Platform, whether they have an account or not.
- Member : user with an account (username + password).
- Content : courses, videos, texts, files, resources, exercises, messages, materials, and more generally any resource made available on the Platform.
3) Accessing the Platform and creating an account
3.1. Access to certain features requires creating an account via the registration form.
3.2. During registration, the user agrees to provide accurate information (email, username, etc.) and to keep it up to date.
3.3. The username and password are strictly personal. The user is responsible for maintaining the confidentiality of their access and for all activity carried out using their account.
3.4. The Publisher reserves the right to suspend or delete an account in the event of non-compliance with the Terms of Service, fraudulent use, or attempt to circumvent security measures.
4) Experimental nature — LMS V1.0 (free)
4.1. The LMS Pro V1.0 platform is currently experimental and free.
4.2. As a result, some features may evolve, be modified, suspended, or discontinued, particularly for maintenance, improvement, or security reasons.
4.3. The current free service does not preclude future developments. Should a paid offer or paid options be introduced, the user will be informed beforehand via the Platform (or any other appropriate means), and specific conditions may apply.
5) Educational purpose and limitations
The Platform offers educational support and online training resources.
The Publisher implements reasonable measures to ensure the quality of the content, but does not guarantee a result (success, certification, obtaining a job, etc.), these elements depending in particular on the user's involvement, context and skills.
6) Rules of use and behavior
The user agrees to:
- not to disrupt the proper functioning of the Platform (intrusion, overload, automated extraction, etc.); ;
- do not circumvent security measures; ;
- do not publish content that is illegal, defamatory, hateful, discriminatory, violent, or infringes on the rights of third parties; ;
- respect the confidentiality of exchanges and materials made available; ;
- use the Platform in accordance with its educational purpose.
In the event of a breach, the Publisher may restrict access, suspend or delete the account, without prejudice to any other necessary action.
7) Intellectual property
7.1. The structure, design, brand, texts, courses, resources, videos, teaching materials, and more generally all elements published on the Platform are protected by intellectual property law.
7.2. Unless otherwise stated, these elements are the exclusive property of the Publisher or its partners/licensees.
7.3. Any reproduction, distribution, modification, extraction, or exploitation (total or partial) without prior written authorization is prohibited.
7.4. The user may view and use the content only for personal and educational purposes on the Platform.
8) Availability, maintenance, security
8.1. The Publisher strives to ensure the accessibility of the Platform, but does not guarantee continuous access.
8.2. Access may be temporarily interrupted for maintenance, updates, technical incidents, service evolution, or security reasons.
8.3. The Publisher cannot be held responsible for interruptions due to the internet network, browsers, user equipment, or force majeure.
9) Responsibility
9.1. The Publisher is bound by an obligation of means. The user uses the Platform at their own risk.
9.2. The Publisher shall not be liable for any indirect damages (loss of data, loss of business, commercial loss) related to the use of or inability to use the Platform.
9.3. The user is responsible for backing up their data and outputs (as far as possible), particularly in the context of the experimental nature of V1.0.
10) Personal data (GDPR)
10.1. Data collected : when creating an account and using the service, the Platform may collect, in particular: email, username, connection data, technical information (logging), and educational progress/usage data.
10.2. Purposes : account management, access to content, educational monitoring, support, security, service improvement.
10.3. Legal basis : performance of the service (access to the Platform), legitimate interest (security, abuse prevention, improvement), and consent when required (non-essential cookies, if applicable).
10.4. Shelf life : data is kept for the duration of the account's existence, then deleted or anonymized within a reasonable time, unless otherwise required by law or necessary for litigation management.
10.5. Recipients : limited access to the Publisher; technical subcontractors strictly necessary for operation (including the hosting provider Gandi).
10.6. Rights : in accordance with the GDPR, the user has rights of access, rectification, erasure, objection, limitation, and portability.

10.7. Complaint : the user can contact the CNIL in case of difficulty.
11) Cookies
The Platform may use cookies/trackers necessary for its operation (session, security, preferences).
Audience measurement or marketing cookies, if they exist, are only placed with consent, via a banner or equivalent mechanism.
12) External links
The Platform may contain links to third-party websites. The Publisher has no control over these websites and accepts no responsibility for their content or practices.
13) Modification of the Terms and Conditions
The Publisher reserves the right to modify these Terms and Conditions at any time.
The applicable version is the one published on the Platform on the date of use. In the event of a substantial modification, a message may be displayed upon login or registration.
14) Applicable law and jurisdiction
These Terms and Conditions are governed by French law.
In the event of a dispute, the parties will seek an amicable solution. Failing that, jurisdiction is granted to the competent courts within the jurisdiction of Montpellier, subject to mandatory legal provisions.
