The user is responsible for maintaining the confidentiality of their access and for all activity carried out using their account.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>3.4.<\/strong> The Publisher reserves the right to suspend or delete an account in the event of non-compliance with the Terms of Service, fraudulent use, or attempt to circumvent security measures.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>4) Experimental nature \u2014 LMS V1.0 (free)<\/summary>\r\n<p class=\"wp-block-paragraph\"><strong>4.1.<\/strong> The LMS Pro V1.0 platform is currently <strong>experimental and free<\/strong>.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>4.2.<\/strong> As a result, some features may evolve, be modified, suspended, or discontinued, particularly for maintenance, improvement, or security reasons.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>4.3.<\/strong> The current free service does not preclude future developments. Should a paid offer or paid options be introduced, the user will be informed beforehand via the Platform (or any other appropriate means), and specific conditions may apply.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>5) Educational purpose and limitations<\/summary>\r\n<p class=\"wp-block-paragraph\">The Platform offers educational support and online training resources.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">The Publisher implements reasonable measures to ensure the quality of the content, but <strong>does not guarantee a result<\/strong> (success, certification, obtaining a job, etc.), these elements depending in particular on the user&#039;s involvement, context and skills.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>6) Rules of use and behavior<\/summary>\r\n<p class=\"wp-block-paragraph\">The user agrees to:<\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\">\r\n<li>not to disrupt the proper functioning of the Platform (intrusion, overload, automated extraction, etc.); ;<\/li>\r\n<li>do not circumvent security measures; ;<\/li>\r\n<li>do not publish content that is illegal, defamatory, hateful, discriminatory, violent, or infringes on the rights of third parties; ;<\/li>\r\n<li>respect the confidentiality of exchanges and materials made available; ;<\/li>\r\n<li>use the Platform in accordance with its educational purpose.<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">In the event of a breach, the Publisher may restrict access, suspend or delete the account, without prejudice to any other necessary action.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>7) Intellectual property<\/summary>\r\n<p class=\"wp-block-paragraph\"><strong>7.1.<\/strong> The structure, design, brand, texts, courses, resources, videos, teaching materials, and more generally all elements published on the Platform are protected by intellectual property law.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>7.2.<\/strong> Unless otherwise stated, these elements are the exclusive property of the Publisher or its partners\/licensees.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>7.3.<\/strong> Any reproduction, distribution, modification, extraction, or exploitation (total or partial) without prior written authorization is prohibited.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>7.4.<\/strong> The user may view and use the content only for personal and educational purposes on the Platform.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>8) Availability, maintenance, security<\/summary>\r\n<p class=\"wp-block-paragraph\"><strong>8.1.<\/strong> The Publisher strives to ensure the accessibility of the Platform, but does not guarantee continuous access.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>8.2.<\/strong> Access may be temporarily interrupted for maintenance, updates, technical incidents, service evolution, or security reasons.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>8.3.<\/strong> The Publisher cannot be held responsible for interruptions due to the internet network, browsers, user equipment, or force majeure.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>9) Responsibility<\/summary>\r\n<p class=\"wp-block-paragraph\"><strong>9.1.<\/strong> The Publisher is bound by an obligation of means. The user uses the Platform at their own risk.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>9.2.<\/strong> The Publisher shall not be liable for any indirect damages (loss of data, loss of business, commercial loss) related to the use of or inability to use the Platform.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>9.3.<\/strong> The user is responsible for backing up their data and outputs (as far as possible), particularly in the context of the experimental nature of V1.0.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>10) Personal data (GDPR)<\/summary>\r\n<p class=\"wp-block-paragraph\"><strong>10.1. Data collected<\/strong> : when creating an account and using the service, the Platform may collect, in particular: email, username, connection data, technical information (logging), and educational progress\/usage data.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>10.2. Purposes<\/strong> : account management, access to content, educational monitoring, support, security, service improvement.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>10.3. Legal basis<\/strong> : performance of the service (access to the Platform), legitimate interest (security, abuse prevention, improvement), and consent when required (non-essential cookies, if applicable).<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>10.4. Shelf life<\/strong> : data is kept for the duration of the account&#039;s existence, then deleted or anonymized within a reasonable time, unless otherwise required by law or necessary for litigation management.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>10.5. Recipients<\/strong> : limited access to the Publisher; technical subcontractors strictly necessary for operation (including the hosting provider Gandi).<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>10.6. Rights<\/strong> : in accordance with the GDPR, the user has rights of access, rectification, erasure, objection, limitation, and portability.<br>To exercise your rights: <a href=\"mailto:infos@lmspro.fr\">infos@lmspro.fr<\/a>.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>10.7. Complaint<\/strong> : the user can contact the CNIL in case of difficulty.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>11) Cookies<\/summary>\r\n<p class=\"wp-block-paragraph\">The Platform may use cookies\/trackers necessary for its operation (session, security, preferences).<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Audience measurement or marketing cookies, if they exist, are only placed with consent, via a banner or equivalent mechanism.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>12) External links<\/summary>\r\n<p class=\"wp-block-paragraph\">The Platform may contain links to third-party websites. The Publisher has no control over these websites and accepts no responsibility for their content or practices.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>13) Modification of the Terms and Conditions<\/summary>\r\n<p class=\"wp-block-paragraph\">The Publisher reserves the right to modify these Terms and Conditions at any time.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">The applicable version is the one published on the Platform on the date of use. In the event of a substantial modification, a message may be displayed upon login or registration.<\/p>\r\n<\/details>\r\n\r\n\r\n\r\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>14) Applicable law and jurisdiction<\/summary>\r\n<p class=\"wp-block-paragraph\">These Terms and Conditions are governed by French law.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">In the event of a dispute, the parties will seek an amicable solution.
